Terms of service.

The agreement between you and Elitesgen Academy when you enrol in a program, use this website, or use either of our apps.

1. Agreement to these terms

These terms apply when you use egenacademy.com, the Egen Academy app, the Egen Academy Team app, or enrol in any Elitesgen Academy program. We call all of that the service.
By creating an account or enrolling, you accept these terms. The account-creation screens say so directly above the button, so there is no separate step to miss. If you are enrolling on behalf of a child in your care, you accept them for yourself and on their behalf. If you do not accept them, do not use the service.
You are contracting with Elitesgen Egen Limited (RC 8151916), of Magodo, Lagos, Nigeria, trading as Elitesgen Academy. In these terms "we" and "us" mean that company.

2. What we do

Elitesgen Academy teaches structured programs in swimming, dance, music, robotics and other disciplines, for children, teenagers and adults, across Lagos and Abuja. We run sessions at our own and at partner venues, and we provide software that lets you enrol, see the schedule, follow progress and pay.
Programs, venues, session times and prices change. What is shown when you enrol is what applies to that enrolment.

3. Accounts

You must be 18 or older to hold an account. A learner under 18 takes part through a parent or guardian's account. A guardian may give a child their own login to see their schedule and progress; the guardian remains responsible for that account and for everything done with it.
Give us accurate information and keep it up to date, particularly contact details and anything we need in an emergency. Keep your password to yourself and tell us promptly if you think someone else has access to your account.
You are responsible for what happens on your account, including enrolments and payments made through it.

4. Enrolment

An enrolment is confirmed when we have accepted it and the payment due at that point has cleared. Places are limited and are allocated when confirmed, not when a form is started.
You are enrolling in a program with a defined curriculum, a level, a venue and a session pattern. We may change a coach, move a session or adjust a venue where we have to, and we will tell you when we do.
We may decline or end an enrolment where a learner's needs cannot be safely met by the program, where required health or emergency information has been withheld, or where conduct puts other learners or staff at risk.

5. Fees and payment

All prices are in Nigerian Naira. The price shown at the point of enrolment, including any discount or coupon applied, is the price for that enrolment.
Payments are handled by Paystack. You are taken to Paystack's own secure checkout to pay; we never see or hold your card number. If you save a card for future payments, we hold only the card brand, the last four digits, the expiry and a token issued by Paystack.
Some programs accept payment by bank transfer with a receipt upload. Payment is not complete until we have confirmed the transfer.
Where an enrolment is paid in instalments, the outstanding balance remains due and access to sessions may be paused while it is overdue.

6. Cancellations, missed sessions and refunds

If we cancel a session for a reason within our control, we will reschedule it or credit it.
If you cancel a learner out of a session at least 3 hours before it starts, that session goes back to their remaining sessions and can be booked again. Cancel with less than 3 hours to go and the session is used. If we cancel the session, it always goes back, however late the notice.
A session a learner simply does not attend, without being cancelled, is used.
Cancelling an enrolment itself is different from cancelling a single session, and we are still settling those terms. Until they are published, requests to withdraw from a program and any refund of tuition are handled case by case. Email support@egenacademy.com and we will tell you where you stand before you commit to anything.

7. Safety, health information and supervision

Physical training carries risk. Our coaches are there to manage it, but they can only manage what they know about.
You must tell us about anything that could affect a learner during a session, including medical conditions, allergies and any medication they take, and you must give us an emergency contact. The forms ask for some of this directly and leave a free-text box for the rest; use it. Coaches and coordinators assigned to that program can see what you tell us, because they need it at the poolside rather than in an office. Keep it current.
In an emergency we will act in the learner's interests, including seeking medical assistance, and we will contact you as soon as we can.
Follow the safety rules at each venue, including any rules set by a partner venue. We may ask anyone who does not to leave.

8. Photography, video and audio

Coaches may record short video, with sound, of a learner during a session as part of assessment and feedback. These recordings are filed against that learner and are visible to the learner and their guardian in the app.
You can tell us not to record a particular learner. Speak to your coordinator or email us, naming the learner, and we will pass it to the coaches working with them and stop. You do not have to give a reason, it does not affect their place in the program, and you can ask us to delete recordings already made at the same time.

We do not use recordings or photographs of learners in our marketing. If we ever want to, we will ask you in writing first, and we will not use anything unless you reply to say yes.
Do not record other people's children at our sessions.

9. Using the apps and this website

We grant you a personal, non-transferable right to use the apps and website to manage your own enrolments and those of learners in your care. You agree not to:
  • use another person's account, or let anyone else use yours;
  • attempt to access records belonging to other families, learners or staff;
  • probe, scan, overload or interfere with our systems;
  • copy, modify, reverse engineer or resell any part of the service; or
  • upload anything unlawful, or anything you do not have the right to upload.
We may suspend or close an account that breaches these rules.

10. Content you provide

You keep ownership of what you upload, such as photographs and documents. You give us permission to store and display it as needed to run the service for you.
The service itself, including our software, curriculum, assessments, certificates and brand, belongs to us or to our licensors.
Certificates we issue remain verifiable through our verification page after they are issued.

11. Staff accounts

Egen Academy Team is for our instructors and coordinators. Access is granted and withdrawn by the academy, and use of it is subject to your engagement with us as well as these terms. Records created through it, including attendance, assessments and incident reports, are academy records.

12. Availability

We work to keep the service available but do not guarantee uninterrupted access. We may take it down for maintenance, and we may add, change or remove features. Where a change materially reduces something you have paid for, we will credit, refund or offer an alternative.

13. Third-party services

The service uses other companies for payments, messaging, storage, notifications and error reporting. They are named in the privacy policy. Their own terms apply to their services, and we are not responsible for their availability.

14. Liability

The service is provided as it stands. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, we are not liable for indirect or consequential loss, or for loss of profits or opportunity, and our total liability for any claim connected with the service or an enrolment is limited to the amount you paid us for that enrolment.
Taking part in physical activity carries inherent risk that competent coaching reduces but does not remove.

15. Closing your account

You can close your account at any time, in either app: Menu, then Privacy & Data, then Delete my account. The delete account page explains what is removed, what we keep, and how to ask us to do it if you cannot use the app. Fees already due remain payable, and records we must keep by law are kept.
We may close or suspend an account where these terms are breached, where fees remain unpaid, or where conduct puts others at risk.

16. Changes to these terms

We may update these terms. If a change is material we will tell you in the app or by email before it takes effect, and we will change the effective date shown at the top of this page. That date is how you tell one version from another.
If you keep using the service after a change has taken effect, that is your acceptance of it. If you would rather not accept a change, tell us and close your account. Fees already due remain payable.

17. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and the Nigerian courts have jurisdiction over any dispute. Nothing here prevents either of us asking a court for urgent protection.
We would rather sort a problem out directly. Contact us first and we will try.
